Distressed Transactions

A distressed probate property is a home going through the probate process while also facing financial challenges such as missed mortgage payments, unpaid property taxes, lapsed homeowners insurance, overdue homeowner association (HOA) dues, or other maintenance issues. If these debts remain unresolved, lenders may begin foreclosure proceedings, and unpaid taxes or HOA fees can lead to further legal action. We specialize in working with the appropriate institutions to negotiate time extensions, helping heirs and executors navigate the complexities of probate while exploring solutions to protect the property’s value.

If a borrower (the homeowner) consistently cannot make payments on their home, their home may be repossessed by the lender to be resold. This process is called foreclosure, and can result in the previous owner’s eviction and a devastating drop in credit score. 

This can be a very stressful process, but there is a solution to prevent foreclosure and its effects: short sales. In a short sale, the home is sold for less than what is owed. In other words, more money is owed on the property than it is actually worth. The proceeds from this sale assist in paying off the debt to the bank, while the remaining debt can be deferred or waived. It is an unfortunate situation to be in, often occurring during recession periods or after housing bubbles (as in the 2008 Great Recession), but it is one possible solution to mitigate the impact of losing one’s home and equity.

Real Estate Owned sales are another type of distressed sale relating to foreclosures. If, after repossessing the property, the lender is unable to auction it off, an agent is called in to sell it as an REO on behalf of the bank. From the buyer’s standpoint, this can come with some advantages: homes are sold at a greatly discounted price, and the new seller (the lender) is highly motivated. On the other hand, the home is sold “as-is,” so the buyer will have to pay for any necessary repairs, liens, and other outstanding fees.
